Usage, Licensing & Production Terms

  1. ArtsByKev Productions provides digital creative services and assets under license. All work is licensed, not sold. Ownership and all copyrights remain exclusively with ArtsByKev Productions at all times unless otherwise explicitly agreed in writing.

  2. By commissioning work or purchasing premade assets, the client acknowledges that production or delivery may begin immediately and expressly agrees to waive any statutory right of withdrawal or refund applicable to digital content once production starts or the asset is delivered. All digital productions are non-refundable.

  3. The client is granted a lifetime, non-exclusive license to use the produced or purchased asset(s) solely for the agreed purpose, limited to display in video and promotional media. The license becomes effective once payment is received or, in the case of premade assets, upon download or delivery.

  4. Premade assets sold through the webshop are licensed under standardized terms. Downloading or receiving the asset constitutes acceptance of the license. Assets may be used only for the permitted media projects and may not be redistributed, resold, sublicensed, or made publicly downloadable.

  5. Clients and third parties may not modify, edit, derive from, or otherwise alter produced or premade assets. Any revisions or changes must be requested from and carried out by ArtsByKev Productions.

  6. ArtsByKev Productions reserves the right to sell, license, or distribute produced or premade assets to third parties. No exclusivity is implied unless explicitly agreed in writing.

  7. Assets may be shared with designated partners solely for setup or configuration during an active production period and only within the scope of the agreed project. Such access grants no publishing, usage, or distribution rights and may be revoked at any time.

  8. Any unauthorized, irregular, or out-of-scope use of assets — paid or unpaid — results in immediate termination of the granted license and loss of usage rights.

  9. ArtsByKev Productions may display produced or premade assets and related material in its own portfolio, promotional, educational, or entertainment content.

  10. Work carried out without a signed agreement is governed by these standard terms by default.

ArtsByKev Productions reserves the right to modify or update these terms at any time. Updates apply to future purchases and productions; licenses granted prior to such changes remain governed by the terms in effect at the time of the transaction.
