Legal Policy & Terms of Service

ArtsByKev Productions provides digital assets and creative services for high-performance creators. By purchasing from our store or commissioning custom work, you agree to the following terms.

1. Digital Goods & No-Refund Policy

All sales are final. Due to the nature of digital content, files cannot be "returned."

  • Express Consent: By completing a purchase, you provide express consent to immediate delivery/access and acknowledge that you waive your statutory 14-day right of withdrawal.

  • No Refunds: No refunds, exchanges, or price protections are provided once production has started or digital files have been accessed.

2. Licensing & Usage Restrictions

All assets are licensed, not sold. ArtsByKev Productions retains full Copyright and Creative Rights at all times.

  • Permitted Use: You are granted a non-exclusive, lifetime license to use assets in your own media productions (Videos, Streams, and Minecraft Server Resource Packs).

  • Strict Prohibitions:

    • Commercial Platforms: Use of assets in revenue-earning products on external platforms such as Roblox, UEFN (Fortnite), or as DLC/sub-content for other games is strictly prohibited. Contact info@artsbykevstudio.com for inquiries regarding partnerships.

    • Resale: You may not redistribute, resell, or make assets publicly available for download.

    • Edits: Clients may not conduct edits, derivations, or alterations. All modifications must be requested from ArtsByKev Productions.

  • Copyright Buyout: Full ownership transfer is available at 5x the base production cost (must be agreed in writing).

3. Production & Service Terms

  • Delivery: Standard delivery for custom projects is 1–2 weeks.

  • Project Pricing: All work is quoted as a fixed total based on scope.

  • Deposits: A 50% non-refundable deposit is required before any production begins.

  • Revisions: One round of minor adjustments is included; additional revisions are charged at $75 per instance.

4. Support & Verification

We only offer support for verifiable orders.

  • Verification: You must provide your Order Number and Full Name to receive support.

  • User Error: We are not responsible for, and offer no support for, lost files, lost emails, computer resets, account bans, or forgotten passwords. Safe-keeping of the assets is the buyer's sole responsibility.

5. EU Business & VAT

  • B2B: VAT-registered EU businesses must not purchase via the automated webstore. Contact info@artsbykevstudio.com for a manual VAT-exempt invoice.

  • Note: We do not issue VAT refunds for business purchases made incorrectly through the automated checkout.

6. Termination of License

Any unauthorized use, breach of scope, or failure of full payment results in the immediate and automatic termination of all usage rights. ArtsByKev Productions reserves the right to alter, derivative, and reuse any produced material for its own portfolio, promotional content, or future commercial distributions. Fraudulent use is a legal matter for the court and will be met with damage fees and DMCA takedowns.

Privacy Policy (GDPR): We comply with GDPR. Your data is handled by ArtsByKev Productions and Squarespace Inc. for service delivery and legal bookkeeping only.

Amendments: ArtsByKev Productions reserves the right to modify or update these terms at any time. Updates apply to future transactions; previous licenses remain governed by the terms in effect at the time of purchase.
